Another DUI Per Se (over 0.08 BAC) Reduced

Our client was involved in a single-car accident and, after complying with the arresting officer’s request for the State test of his breath, blood, urine or other bodily substance (Implied Consent), a Blood Alcohol Content (BAC) of over 0.08 resulted. On behalf of our client, first we dealt with the requested suspension of his license based on the Per Se DUI arrest (per se meaning over a 0.08 BAC). Then, we dug into the facts and legalities of the incident and arrest, and were able to negotiate a reduced, non-DUI charge for our client with NO JAIL TIME and significantly reduced probation time (3 months versus the normal 1 year on a DUI).
