DUI Didn’t Have Ghost of a Chance

This Halloween case wasn’t scary for my client. It started in Kennesaw Municipal Court in Cobb County, but I moved the matter to Cobb County State Court. While my client may have been intoxicated, there was no proof via a test of her blood, breath, urine or other bodily substance. I showed the prosecutor and judge the reason for the initial stop was suspect. The arresting officer alleged an improper use of her vehicle’s horn and failure to maintain lane. I had the case reduced to a zero-point, Basic Rules / Too Fast for Conditions ticket with no fine, no jail time, and early termination of probation. Which, because the client took my advice and completed several tasks, she didn’t have any probation. This case took a long time to work out. But I never stopped working for my client.
